Real Estate Due Diligence for Lawyers
From the first file review to a signed legal opinion on title
Course Overview & Objectives
Course Overview & Objectives
Clients, banks and developers ask lawyers for one thing before they pay: is this title safe? Answering that question properly takes more than reading the latest deed. It needs a method.
This course gives lawyers that method. We go through the full due diligence process the way it is done in practice: collecting certified records, tracing the deed chain, checking the land office and the authority, visiting the land, and writing a legal opinion the client can rely on. Each class uses real (anonymised) files, and you will draft your own opinions during the course.
The aim is simple. By the end, you should be able to take a land or apartment file from a client, finish the work, and put your name on the opinion with confidence.
Core Topics of this Course
- Building a due diligence file: what to collect, from where, and in what order
- Title search through CS, SA, RS, BS and city survey records
- Deed-chain review, inheritance shares and missing parties
- Searching sub-registry volumes for later transfers, bainas and mortgages
- Checking pending suits, injunctions and acquisition proceedings
- Apartment and developer project due diligence
- RAJUK, NHA and MoHPW leasehold plots, including the 2025 transfer rule
- Drafting a legal opinion on title: clear, conditional or adverse
